Wants To Make Sure You Are Online!

All of our Websites are designed on a scheduled basis. You will need to provide us with hosting for your site.  If you do not currently have hosting we can provide that for you at a reasonable rate. 

Completion of your site depends on how quickly you provide us the content (photos and text) for your site.  If you forward all of content to us promptly we can start on your site as scheduled. You are responsible for sending your photos to us within 5 days of purchase.  This ensures that your site work will begin as scheduled.  If you can't provide content within that time frame we will have to reschedule your design time.  Please be specific and let us know which photos you wish to have in your website header. Any new photos sent afterwards will result in a fee to change graphics.

Hosting (if provided by ADD), which includes Domain Renewal will be billed by our hosting company; it is your responsibility to be aware of your site renewal date to ensure your website remains online.  If your site has been terminated because of non payment for hosting/domain renewal there will be a fee to republish the site's pages.  Depending on how long you wait to renew depends on whether your site backup has been deleted from the hosting servers.

How To Take Photographs Of Your Dogs:

Photos should be taken outside on a well lit day without hard shadows covering your dog. First and foremost make sure your dog is clean.  Place your dog on a hard surface to ensure that his feet will be visible for your page header and custom work. When taking photos make sure you do not omit feet, tails and ears from the shot. Take 3 each front, side and front angled shots of each dog and send those photos in the original size, we will crop and resize your photos as needed. Send your photos by email, or by uploading them to a free www.photobucket.com account online. Be sure to send us your user name and login so we can get access your uploaded photos.   Please keep in mind, high resolution photos are needed.  Great photos insure a great site!

Terms and Conditions of Website Design

Our desire is to satisfy our clients. One way is to make clear our understandings with each other. These are the terms of our agreement together:

1.  Authorization. The client is engaging After Dark Design, as an independent contractor for the specific project of developing and/or improving a World Wide website to be installed on the client's web space on a web hosting service's computer. The client hereby authorizes After Dark Design to access this account, and authorizes the web hosting service to provide After Dark Design with "write permission" for the client's webpage directory, cgi-bin directory, and any other directories or programs which need to be accessed for this project.

2. Standard Website Package Elements. After Dark Design includes the following elements in their Standard Website Packages:

• E-mail consultation General Internet orientation education and Web design consultation. If phone consultation is desired long distance charges are in addition to package rates quoted.
• Words of text supplied by the client.  Web pages of more than 1,200 words of text may be subject to additional fees, especially if they require a great deal of formatting.
• Links to external pages.
• Custom Graphics Package. Masthead/Banner graphic and/or logo on first page (custom graphic incorporating company logo). Top-of-page graphic for all other pages in your website. Colorful lines and bullets, and colored and textured background.
• Photos and other misc. graphic images supplied by client
• Installation of web pages on the client's web hosting service.
• E-mail response link on each webpage to any e-mail address the client designates.
• Feedback/guest book  This is a free guestbook provided by Smart GB or Bravenet.  If this service is terminated by author After Dark Design has no control nor is responsible for replacing this service.

3. Standard Website Packages.   The content of the web pages will be supplied by the client and executed as specified by the client.  Please send us your final text. Time required to make substantive changes to client-submitted text after the web pages have been constructed will be additional, billed at an hourly rate.

So, what is bandwidth?  Any discussion of Internet connectivity   begins with the notion of bandwidth. Simply defined, bandwidth is the amount of information or data that can be sent over a network connection in a given period of time.  Some companies call it Transfer.  When you access a web site, you are downloading a file.  This file can be an HTML web page, a GIF image, a MIDI sound file, or a combination of these. These files are downloaded to your computer and displayed in your web browser.

          Each time you download a file, data is being transferred. The amount of data depends on the size of the file. If you download a web page   that is 1 kilobyte (1,024 bytes), or 1 kb, in size, then 1 kb of data has been transferred. If 100 people access that same web page, then 100  kb of data has been transferred.

        Bandwidth is the term used to measure the amount of data being    transferred from your web space. This does not directly relate to the number of 'Hits' a web site receives. One single hit to a web page that is 100 kb in size uses the same amount of bandwidth as 100 hits to a 1 kb page.

E.   Uptime guarantee supplied by hosting company of 99.98% per month.

4.  Web Design Fees.  The client agrees to pay After Dark Design $_______ for each page designed.  Any additional pages will carry the same design fee for the period of one year.  After that one year period design fees will be assessed on a fair value basis determined by After Dark Design.  Flash designs may incur and additional fee. 

5. Website Maintenance.  Web site maintenance services include revising, editing, or otherwise changing existing web pages to keep your website up to date.  The worth of keeping a website is its ability to maintain current information online at a reasonable cost. We assume that you want to revise some or all of your web pages over time, as well as adding additional web pages.  After Dark Design offers the following Options for website maintenance.

          Option 1 - If you feel that you will not make many changes to your website over time, we can provide web site maintenance services on a per each basis,   at $7.00 per each, with a $ 14.00 minimum charge. The minimum charge is necessary to cover uploading time for changing your website. These rates are consistent with our website development charges.  These changes are sold in blocks of 4 equaling a $28.00 per instance charge.  These updates maybe used at any time and do not expire. 

          Option 2  - If you believe you will be making regular changes to your website over time, you can save money by purchasing a web site maintenance contract. A web site maintenance contract is for a one-year term, and is non-refundable. The monthly charges for maintenance are based on the size of your website at the time the contract is signed.  This  fee is a per month fee and is incurred each month for a 12 month period.                 

          Option 3 Pay Annually

 6. Completion Date. After Dark Design and the client must work together to complete the website in a timely manner. We agree to work expeditiously to complete the website.   After the period of 30 days from the last content sent by client and work perform by After Dark Design the site is considered complete and any additional work will incur maintenance costs.

7. Payment of Fees. Fees to After Dark Design are due and payable on the following schedule:

          Hosting Fees.  Prepaid prior to start of design, as that these fees are paid to a company outside of After Dark Design. 

          Design Fees.   60% upon signing this contract, 40% when the web pages have been constructed according to the client's original written     specifications. If the total amount of this contract is less than $500.00, the  total amount shall be paid upon signing this contract.

          Maintenance Fees.  All maintenance fees must be prepaid.  Pay Pal fees will apply if Pay Pal is used for payment.

8. Assignment of Project. After Dark Design reserves the right to assign subcontractors to this project to insure on-time completion.

9. Legal Stuff. After Dark Design does not warrant that the functions contained in these web pages or the Internet website will meet the client's requirements or that the operation of the web pages will be 100% uninterrupted or error-free. The entire risk as to the performance of the web pages and website is with hosting company. In no event will After Dark Design be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, even if After Dark Design has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

10. Copyrights and Trademarks. The client represents to After Dark Design and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to After Dark Design for inclusion in web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend After Dark Design and its subcontractors from any claim or suit arising from the use of such elements furnished by the client. All graphics, text, photo, designs, trademarks furnished by After Dark Design remain the property of After Dark Design and are copyrighted.  The client has permission to use for the sole purpose of displaying on website designed by After Dark Design.  Additional fees may apply if graphics are required for other uses such as t-shirts, business cards, banners etc.  After Dark Design also reserves the right to apply its copyright, name and website address to any design or items that are printed or published for advertising purposes.

11. Laws Affecting Electronic Commerce. From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The client agrees that the client is solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend After Dark Design and its subcontractors from any claim, suit, penalty, tax, or tariff arising from the client's exercise of Internet electronic commerce.

12. Copyright to Web pages and Graphics. Copyright to the finished assembled work of web pages and/or any graphic copulation produced by After Dark Design is owned by After Dark Design. Upon final payment of this contract, the client is assigned rights to use as a website the design, graphics, and text contained in the finished assembled website. Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the client, and remain the property of their respective owners. After Dark Design and its subcontractors retain the right to display graphics and other Web design elements as examples of their work in their respective portfolios.

13. Payment of fees. In order for After Dark Design to remain in business, payments must be made promptly and in a timely manner. All  maintenance agreement payments are due by 10th of each month.  Delinquent payments will be assessed a $5 charge if payment is not received within 10 days of this due date. If an amount remains delinquent 30 days after its due date, an additional $25.00 penalty will be added for each month of delinquency. After Dark Design reserves the right to remove web pages from viewing on the Internet until final payment is made. In case collection proves necessary, the client agrees to pay all fees incurred by that process. This agreement becomes effective when first payment and deposit is rendered. 

The undersigned agrees to the terms of this agreement on behalf of his or her organization or business.
